Changes to the International Markets Trading Terms and Conditions effective 9 November 2026.

We have made changes to the International Markets Trading Terms and Conditions, which will take effect on 9 November 2026. A summary of the changes is below:

  • Expanded the definition of Authorised Operator to clarify account access, permissions and authority across customer accounts and account components.
  • Added new definitions for Designated Account, Payee, Multi-Factor Authentication (MFA) and Security Credentials.
  • Added new definitions for Extended Hours Trading, Overnight Trading Session and Regular Market Session to support new 23/5 US trading functionality.
  • Introduced MFA requirements and enhanced account security controls.
  • Added new Operational Trust Account disclosures, including disclosure that AUSIEX may retain interest earned on operational trust account balances.
  • Introduced a Designated Account framework for withdrawals from AUSIEX Cash Accounts, including support for nominated third-party withdrawal accounts.
  • Added provisions supporting adviser fee deductions from AUSIEX Cash Accounts where customers have provided the required consent and payment direction.
  • Introduced scheduled deposits and scheduled payments functionality for AUSIEX Cash Accounts.
  • Enhanced transaction monitoring, verification, fraud prevention, sanctions screening and payment security controls.
  • Introduced Extended Hours Trading (23/5 US trading) functionality, including new order handling rules, pricing disclosures and trading session provisions.
  • Expanded customer disclosures regarding the risks of trading outside regular market hours, including liquidity, volatility, market data, execution and settlement risks.
  • Added provisions addressing Extended Hours Trading service availability, execution delays and limitations of liability associated with after-hours trading activity.
  • Updated disclosures relating to operational trust accounts and the Financial Claims Scheme (FCS).
  • Consolidated Applicable Law, Unfair Contract Terms, Severance, Notice and Variation of Terms and Conditions provisions into a single General Provisions section.
  • Part 24 now combines Complaints and Dispute Resolution including complaint handling, internal dispute resolution and AFCA escalation processes.
  • Updated document structure, clause sequencing and numbering to improve consistency, readability and alignment with other AUSIEX terms and conditions.

The following amendments introduce new functionality, security measures, operational processes or customer authorities.

Part 1 - Definition of Authorised Operator

Authorised Operator means an adviser or other person whom You have authorised to operate or access Your AUSIEX Cash Account with either view only access or view and transact access. AUSIEX will act on written instructions from an Authorised Operator without further confirmation from You.

Definition expanded to clarify that an Authorised Operator may access or operate Your Account, or any component of Your Account, in accordance with authority, access levels and permissions granted by You, including viewing, trading, transacting, providing instructions and updating personal details. AUSIEX may act on instructions received from an Authorised Operator within the scope of that authority without further confirmation from You.

Expanded to clarify that authority may include initiating or arranging deductions from an AUSIEX Cash Account for ongoing adviser fees where a valid consent and payment direction has been provided.

Debits and credits are made in accordance with authority provided by You or Your Authorised Operator.

Expanded to permit withdrawals to a Designated Account nominated by You or Your Authorised Operator.

Part 4, Clause 7.9

AUSIEX will not withdraw funds without explicit instruction and/or standing instruction.

Clarified that withdrawals may occur where instructed by account holders, instructed by an Authorised Operator, made under a standing instruction or made pursuant to a valid adviser fee deduction authority.

Part 4, Clause 9.2

Standing authority permitted deductions for fees, charges, taxes, monies owed to AUSIEX and correction of errors.

Standing authority expanded to include adviser fee deductions authorised under a separate adviser fee deduction consent and payment direction.

Part 4, Clause 9.3

The nominated bank account used for withdrawals must be in the name of Your Account.

Clarified that the nominated bank account is used for both deposits and debits and must be held in the name of Your Account.

Part 4, Clauses 9.3.1 - 9.3.3

New Designated Account framework introduced. You or Your Authorised Operator may nominate a Designated Account for withdrawals. A Designated Account may be Your nominated bank account or another nominated account and may be held by another person or entity.

AUSIEX may impose transaction limits and refuse or delay processing where it has a legitimate business, security, legal or compliance reason.

Expanded to permit screening, monitoring, verification, restriction, refusal or delay of deposits, withdrawals, transfers and payments, including those involving a Designated Account or Payee, for fraud prevention, AML/CTF, sanctions, security and regulatory compliance purposes.

Part 4, Clause 9.6(b)

AUSIEX may request additional information or documentation before processing a transaction or permitting use of a Designated Account or Payee.

Part 4 - Scheduled Deposits and Payments

New section added allowing recurring deposits and recurring payments, including establishment, amendment, pausing, cancellation and processing of scheduled transactions.

Part 4 - Fees and Charges

Existing fee variation provisions.

Clarified that at least 30 days' notice will be provided for changes to fees and charges applicable to the AUSIEX Cash Account.

Part 4 - Financial Claims Scheme

General disclosure regarding FCS eligibility.

Updated disclosure clarifying that AUSIEX cannot provide advice regarding the application of the FCS and directing customers to APRA guidance and independent advice.

Part 5, Clause 11(a)-(c)

Introduces Extended Hours Trading functionality. Customers may place orders outside regular exchange trading hours, subject to exchange and service provider rules. Certain order types may not be available during Extended Hours Trading and unexecuted orders may be automatically cancelled at the end of an Extended Hours Trading session and require resubmission.

Part 5, Clause 11(d)

Existing disclosure referred generally to risks associated with trading outside exchange market hours.

Expanded risk disclosure to specifically address risks associated with Extended Hours Trading, including lower liquidity, increased volatility, wider bid-offer spreads, reduced market depth, reduced price transparency, delayed market data, execution delays, partial order execution, trading halts, corporate action impacts and settlement timing differences.

Part 5, Clause 11(e)

No equivalent provision.

Clarifies that prices available during Extended Hours Trading may differ materially from prices available during a Regular Market Session and may not reflect prices when the primary market opens.

Part 5, Clause 11(f)

Clarifies that market data, pricing information and market depth information may be delayed, unavailable, incomplete or otherwise differ from information available during a Regular Market Session.

Part 5, Clause 11(g)

Clarifies that transactions executed during an Overnight Trading Session may be allocated a different trade date and will settle in accordance with exchange and clearing facility requirements.

Part 5 Clause 12 (previously Part 5 Clause 11)

Withdrawal requests could be made from Funding Accounts.

Clarified that withdrawals from International Markets Funding Accounts must be made in Australian dollars and remitted to the linked nominated bank account.

Part 6, Clause 8

No equivalent provision.

Introduces additional disclosure that delays in transmission, processing or execution of orders may be more likely during Extended Hours Trading due to reduced liquidity, exchange maintenance, technology limitations and third-party dependencies.

Part 9, Clause 6

No equivalent provision.

Clarifies that Extended Hours Trading functionality is dependent on third-party exchanges, brokers, custodians and technology providers and may be interrupted, suspended or limited.

Part 14, Clause 3

No equivalent provision.

Introduces a limitation of liability provision relating to participation in Extended Hours Trading, including losses arising from reduced liquidity, price volatility, delayed market data, cancelled orders, corporate actions, market halts and differing trade dates.

Part 19, Clause 4

No equivalent provision.

Clarifies that Extended Hours Trading may not be available for all exchanges, markets or International Securities and may be amended or withdrawn at any time.

Part 19, Clause 5

Clarifies that trading hours applicable to International Securities are determined by the relevant exchange and may change without prior notice.

Part 24 – Complaints and Dispute Resolution

Complaints, dispute resolution and regulatory matters previously appeared within Part 4, Clause 20

New standalone complaints and dispute resolution framework, including complaint handling commitments, internal dispute resolution requirements, AFCA escalation rights and mediation provisions.


Consolidation and Relocation Changes

The following provisions have been consolidated and relocated to a single section of the Terms and Conditions to improve consistency and ease of reference. These changes do not materially alter the operation of the relevant provisions.

Severance provisions were located in Part 18.

Severance provisions have been relocated to Part 1 General Provisions to consolidate general legal provisions into a single section.

Part 18.3 – Unfair Contract Terms

Unfair Contract Terms provisions have been relocated to Part 1 General Provisions and updated to align with the Share Trading Terms and Conditions.

Part 15 – Variation of Terms and Conditions

Variation provisions were contained within Part 15.

Variation provisions have been moved into Part 1 General Provisions and updated to align with the Share Trading Terms and Conditions.

Notice Provisions

Notice requirements were referenced throughout the document.

A dedicated Notice section has been introduced into Part 1 setting out how notices may be given and when notices are deemed received.

Complaints and Dispute Resolution

Complaint handling provisions were not contained in a standalone section.

A dedicated Part 24 – Complaints and Dispute Resolution has been added to provide customers with a centralised complaints and dispute resolution process.

The updated International Markets Trading Terms and Conditions will be available to download from 9 November 2026.
