Changes to the Share Trading Terms and Conditions effective 7 November 2026.

We have made changes to the Share Trading Terms and Conditions, which will take effect on 7 November 2026. A summary of the changes is below:

  • Replaced all references of Cboe Australia Pty Ltd (Cboe) with TMX Australia Exchange (TMX) to align with the entity’s updated name.
  • Expanded the definition of Authorised Operator to clarify account access, permissions and authority.
  • Added new definitions for Designated Account, Payee, Multi-Factor Authentication (MFA) and Security Credentials.
  • Introduced MFA requirements and enhanced security controls.
  • Added new Operational Trust Account disclosures.
  • Introduced a Designated Account framework for AUSIEX Cash Account withdrawals.
  • Added provisions supporting adviser fee deductions from AUSIEX Cash Accounts.
  • Introduced scheduled deposits and scheduled payments functionality for AUSIEX Cash Accounts.
  • Enhanced transaction monitoring, verification, fraud prevention and payment screening controls.
  • Updated disclosures relating to settlement trust accounts and the Financial Claims Scheme (FCS).
  • Consolidated Applicable Law, Unfair Contract Terms, Severance, Notice and Variation of Terms and Conditions provisions into a single section.
  • Consolidated complaints and dispute resolution provisions into a new Part 9 - Complaints and Dispute Resolution.
  • Updated document structure and clause numbering to improve consistency and readability

The following amendments introduce new functionality, security measures, operational processes or customer authorities.

Part 1 - Definition of Authorised Operator

Authorised Operator means an adviser or other person whom You have authorised to operate or access Your AUSIEX Cash Account with either view only access or view and transact access. AUSIEX will act on written instructions from an Authorised Operator without further confirmation from You.

Definition expanded to clarify that an Authorised Operator may access or operate Your Account, or any component of Your Account, in accordance with authority, access levels and permissions granted by You, including viewing, trading, transacting, providing instructions and updating personal details. AUSIEX may act on instructions received from an Authorised Operator within the scope of that authority without further confirmation from You.

Part 1 - New Definition

Part 1 - Operational Trust Accounts

New Operational Trust Account provisions added. AUSIEX may maintain trust accounts for operational purposes, funds may be held temporarily in those accounts and AUSIEX may retain any interest or other financial benefit earned on those accounts.

Part 2 - Security Identification

Individual Username requirements only.

New MFA requirements added. Clients must protect MFA credentials, one time passwords and passkeys and notify AUSIEX if an MFA device or credential is compromised.

Part 2, Clause 3.4

Authorised representatives may provide instructions and access Services on behalf of clients.

Expanded to clarify that authority may include initiating or arranging deductions from an AUSIEX Cash Account for ongoing adviser fees where a valid consent and payment direction has been provided.

Part 2 - New Acknowledgement

No equivalent provision.

New acknowledgement added confirming that instructions and actions undertaken by an adviser or Authorised Operator are deemed to be authorised by the client, including certain account maintenance activities.

Part 3, Clause 2.13

The Participant is required to maintain a trust account to hold funds on Your behalf used for Your share trading account. The Participant will retain any interest earned on the account.

Clarified that this disclosure applies only to settlement trust accounts used for share trading settlement and does not apply to the AUSIEX Cash Account.

Part 4, Clause 7.6

No adviser fee deduction authority provisions.

New provisions added permitting advisers or their licensees to request adviser fee deductions from an AUSIEX Cash Account where the required consent and payment direction requirements have been met.

Part 4, Clause 7.7

Debits and credits are made in accordance with authority provided by You or Your Authorised Operator.

Expanded to include instructions arising under adviser fee deduction consents and payment directions and to permit nomination of a Designated Account.

Part 4, Clause 7.9

AUSIEX will not withdraw funds without explicit instruction and/or standing instruction.

Clarified that withdrawals may occur where instructed by account holders, instructed by an Authorised Operator, made under a standing instruction or made pursuant to a valid adviser fee deduction authority.

Part 4, Clause 9.2

Standing authority permitted deductions for fees, charges, taxes, monies owed to AUSIEX and correction of errors.

Standing authority expanded to include adviser fee deductions authorised under a separate adviser fee deduction consent and payment direction.

Part 4, Clause 9.3

The nominated bank account used for withdrawals must be in the name of Your Account.

Clarified that the nominated bank account is used for both deposits and debits and must be held in the name of Your Account.

Part 4, Clauses 9.3.1 - 9.3.3

No equivalent provisions.

New Designated Account framework introduced. You or Your Authorised Operator may nominate a Designated Account for withdrawals. A Designated Account may be Your nominated bank account or another nominated account and may be held by another person or entity.

Part 4, Clause 9.4

New adviser fee deduction framework added, including consent requirements, adviser responsibilities, processing conditions, notification obligations and record retention requirements.

Part 4, Clause 9.6

AUSIEX may impose transaction limits and refuse or delay processing where it has a legitimate business, security, legal or compliance reason.

Expanded to permit screening, monitoring, verification, restriction, refusal or delay of deposits, withdrawals, transfers and payments, including those involving a Designated Account or Payee, for fraud prevention, AML/CTF, sanctions, security and regulatory compliance purposes.

Part 4, Clause 9.6(b)

No equivalent provision.

AUSIEX may request additional information or documentation before processing a transaction or permitting use of a Designated Account or Payee.

Part 4 - Scheduled Deposits and Payments

No equivalent functionality.

New section added allowing recurring deposits and recurring payments, including establishment, amendment, pausing, cancellation and processing of scheduled transactions.

Part 4 - Fees and Charges

Existing fee variation provisions.

Clarified that at least 30 days' notice will be provided for changes to fees and charges applicable to the AUSIEX Cash Account.

Part 4 - Financial Claims Scheme

General disclosure regarding FCS eligibility.

Updated disclosure clarifying that AUSIEX cannot provide advice regarding the application of the FCS and directing customers to APRA guidance and independent advice.

Part 9 - Complaints and Dispute Resolution

Complaints and dispute resolution provisions appeared in multiple parts of the Terms and Conditions.

New Part 9 introduced to consolidate complaints handling, internal dispute resolution, AFCA escalation rights and mediation arrangements.


Consolidation and Relocation Changes

The following provisions have been consolidated and relocated to a single section of the Terms and Conditions to improve consistency and ease of reference. These changes do not materially alter the operation of the relevant provisions.
