Changes to the Share Trading Terms and Conditions (T&Cs) effective 11 May 2026.

We have made changes to the Share Trading Terms and Conditions, which will take effect from 11 May 2026. A summary of the changes are below:

  • ‘Docusign’ replaced by ‘Electronic Signature’
  • ‘Webchat’ replaced with ‘Live Chat’
  • Insertion of new Part 4 - AUSIEX CASH ACCOUNT
  • Structural change with the Terms & Condition now being split into 8 Parts.

PART 1 - DEFINITIONS

None

The following new definitions have been added:

1.11 AUSIEX Cash Account means the cash account facility held by AUSIEX in its own name as bare trustee for You, the funds in the cash account facility are maintained in a trust account with Australia and New Zealand Banking Group Limited (ANZ), an Authorised Deposit-taking Institution (ADI), for holding, receiving and making payments linked to Your Account;

1.12 Authorised Operator means an adviser or other person whom You have authorised to operate or access Your AUSIEX Cash Account with either view only access or view and transact access. AUSIEX will act on written instructions from an Authorised Operator without further confirmation from You;

1.18 Client Money means funds held on Your behalf by AUSIEX in accordance with the Corporations Act 2001 (Cth), including funds held in the AUSIEX Cash Account;

1.21 Direct Debit Arrangement means the arrangement established by You with AUSIEX that authorises AUSIEX to debit fees, charges, taxes or other amounts payable from Your AUSIEX Cash Account or nominated bank account in accordance with the terms of the Direct Debit/Credit Request Service Agreement;

1.23 Financial Claims Scheme (FCS) means the Australian Government scheme administered by APRA that provides protection to eligible deposit holders with authorised deposit-taking institutions, subject to applicable eligibility criteria and limits;

1.30 Live Chat (also known as 'WebChat' means the online chat functionality available on the Trading Site that allows you to communicate with a virtual assistant or a member of our staff for general, self service enquiries only and cannot be used to submit trade orders or other instructions;

1.18 DocuSign means the cloud-based electronic signature technology that allows users to sign documents electronically.

Other product offerings resulting in an ongoing fee

1.45 Trading Site means the internet/mobile site address or other digital channel through which access is gained to share market trading functions;

1.51 Trading Site means the internet/mobile site address or other digital channel through which You and/or Your Authorised Operator may access share market trading functions, cash balances, and operate Your AUSIEX Cash Account;

 

1.59 Your Account means the account/s you hold with AUSIEX, including the AUSIEX Cash Account and share trading account/s opened by You with the Participant, used for settlement, cash management and related trading activities;

GENERAL

2.10 You agree and acknowledge that all proceeds of Your “Sell” orders are to be paid into Your Cash Account or any bank account nominated and authorised by You in writing from time to time. You irrevocably direct the Participant to deduct from Your Cash Account from time to time and to the maximum extent permitted by the Corporations Act, any and all amounts owed by You to the Participant under or in connection with these Terms and Conditions, including without limitation any amounts due to the Participant in respect of any costs, fees, expenses, taxes or reimbursements.

2.10 You agree and acknowledge that all proceeds of Your “Sell” orders are to be paid into Your Cash Account, Your AUSIEX Cash Account or any bank account nominated and authorised by You in writing from time to time. 9.0 FAILURE TO SETTLE

9.1 If You have authorised the Participant to direct debit Your Cash Account, the transfer of cleared funds will occur on the day following the transaction. If the direct debit fails for any reason, You will be required to remit cleared funds via BPAY®. 9.2 If You have not authorised the Participant to direct debit Your Cash Account, You will be required to have cleared funds available prior to a transaction being allowed to proceed.

DIRECT DEBIT/CREDIT REQUEST SERVICE AGREEMENT (old) PART

This agreement sets out details of the terms on which You authorise the Participant to arrange for amounts owing to us to be made by deduction from Your account at Your financial institution or for amounts to be credited to Your account.

This agreement sets out details of the terms on which You authorise the Participant to arrange for amounts owing to us to be made by deduction from Your Cash Account at Your financial institution or the AUSIEX Cash Account. You also authorise the Participant, upon Your request to initiate a direct debit from Your Cash Account at Your financial institution or your AUSIEX Cash Account for the amount You have instructed, to be deposited into Your Account/s. You acknowledge and agree that these debits will be made to facilitate the funding of Your AUSIEX Cash Account as directed by You or an Authorised Operator. This authority permits the Participant to process such debits in accordance with the drawing arrangements notified to You under this Direct Debit Agreement. You also authorise the Participant to arrange for credits to be paid from Your Account to Your Cash Account or Your AUSIEX Cash Account for any sale proceeds or amounts owing to You, or other amounts directed by You or an Authorised Operator.

2. Where the settlement date falls on a non-Business Day, the Participant will draw the amount on the following Business Day. Please contact Your financial institution direct if You are uncertain when a debit will be processed to Your account.

6. The Participant will advise You fourteen (14) days’ in advance of any changes to the Direct Debit/Credit arrangements.
